Petitioners challenged the language of a certified ballot title and summary that Defendant prepared for Initiative Petition 1 (2018). Petitioners contended because a sentence in the summary is misleading, that it did not comply with ORS 250.035(2)(d) and must be modified. A ballot summary must be “concise and impartial.” ORS 250.035(2)(d). An Attorney General may make legal interpretations, but cannot choose only one interpretation for a ballot summary. The ballot title is referred to the Attorney General for modification.
