Defendants Forest Products raised seven assignments of error in their appeal to the Oregon Supreme Court and Plaintiffs Greenwood raised a single assignment of error on cross-appeal; all but Defendants' fifth and seventh errors were rejected. On remand, regarding Defendants' seventh assignment of error, the Court of Appeals held Defendants were entitled to expert expenses in addition to the attorney fees they had been awarded and remanded to the trial court for that award. Defendants' fifth assignment of error was rejected. General judgment affirmed; plaintiffs' attorney fee award in supplemental judgment on breach of contract claim affirmed; defendants' attorney fee award in supplemental judgment on counterclaim for nonpayment of promissory notes remanded for the court to award reasonable expert expenses to defendants; on cross-appeal, affirmed.
