Opinion (Wright): Wilden Pump and Engineering LLC (Wilden) alleged trademark infringement against JDA Global LLC (JDA). JDA makes aftermarket pump parts for pumps built by Wilden. The after-market parts made by JDA use the same replacement part codes as those used by Wilden. Wilden claims to own a trademark in its part codes. The codes are made up of the following scheme: XX-YYYY-ZZ. XX designates the size of the pump, YYYY designates the part itself, and ZZ designates the material the part is made of. The court found that the codes were descriptive of the product only and the source identifier is the prefix to the code. The court GRANTED JDA’s motion for partial summary judgment.
